Licenses and Permits

Below is a listing of activities that require Licenses, Permits, and Registrations in the Borough:

Licenses

Excavator and Snow Mover License 
In order to excavate into or move snow upon Borough property, Borough streets, or Borough rights-of-way, a person must have a valid Excavator and/or Snow Mover License.  Additionally, in order to excavate 2 feet or more in depth in the Borough, on other than Borough property, a Borough street, or a Borough right-of-way, a person must have a valid Excavator and Snow Mover License.

Transient Retail Business License
In order to engage in any transient retail business in the Borough of Myerstown, a person must have a valid Transient Retail Business License.  Transient Retail Business is defined as:
  • Engaging in peddling, canvassing, soliciting, or taking orders, either by sample or otherwise, the Borough of Myerstown.
  • Selling, soliciting, or taking orders for any goods, wares, or merchandise, upon any of the streets or alleys, sidewalks or public grounds, or from house to house, within for any goods, wares or merchandise, from a fixed location within the Borough, on a temporary basis, which shall include, but shall not be limited to, such activities conducted at the time of special occasions or celebrations, for seasonal purposes, or for or in advance of specific yearly holidays.

Permits

Zoning Permit
Any of the following activities, or any other activity regulated by the Borough's Zoning Ordinance, requires a Zoning Permit: 
  1. Erection, construction, movement, placement or extension of a structure, building or sign, including but not limited to a fence or wall that is more than 3 feet in total height,
  2. Change in the type of use of a structure or land, or expansion of a use,
  3. Creation of a lot or alteration of lot lines,
  4. Creation of a new use,
  5. Demolition of a principal building, or partial demolition of the exterior of a principal building, if that building is regulated under Part 8,
  6. Site Alterations or Mineral Extraction as defined by Section 15-1502, and/or
  7. Construction of a motor vehicle driveway, parking pad or parking lot.

Sign Permit
All signs are regulated by the Borough's Zoning Ordinance.  A zoning permit is required for all signs except for: a) signs meeting the requirements of Section 27-1203 of the Zoning Ordinance, and b) non-illuminated window signs.

Building Permit
In July of 2004, Myerstown Borough adopted and incorporated by reference the Pennsylvania Uniform Construction Code (UCC).  The Pennsylvania UCC establishes minimum construction standards for virtually all residential and commercial construction activity within Pennsylvania.   To ensure all buildings in Myerstown Borough are in compliance with the Pennsylvania UCC, building permits are required for all major building and property renovations.

Street Opening and Closing Permit
A permit is required to for all street openings and closings.

To obtain a street opening or closing permit, contact the Borough Office. 

Permit to Excavate in Street or Alley
No person shall make any opening or excavation in any street or alley in the Borough of Myerstown without first having obtained a permit and paid the fee therefore as required by the applicable ordinance of the Borough. No such permit shall be granted for the opening or excavation of a paved street or alley, within a period of 5 years from the time of completion of the paving or improvement of such street or alley except in case of unavoidable accident, and then with special permission of the Borough Council.

Permit to Erect or Replace a Pole
No telegraph, telephone, electric light, electric power poles or other similar poles shall be erected or old poles be replaced with new ones within the limits of the Borough unless a permit has been obtained.

Permit to Erect or Install Guy Anchors
No guy anchors shall be erected or installed at any location in the Borough unless a permit has been obtained.

Permit to Distribute Advertising Matter or Circulars
No person shall distribute any advertising matter and/or circulars in the Borough of Myerstown, whether upon the streets and sidewalks thereof, or from house to house and/or place to place without first having obtained a permit from the Borough.

Permit to hold Circus or Carnival
It is unlawful for any person to hold or conduct any circus or carnival at any place in the Borough of Myerstown without first having obtained a permit issued by Borough Council.

Temporary Dumpster Permit
A temporary dumpster may be placed within a street right-of-way where necessary for on-site work, provided such dumpster does not obstrcut traffic or safe sight distances.

Wastewater Connection Permit
No connection shall be made to any public sewer except upon payment of the prescribed connection fee and upon permit issued by the sewer authority pursuant to rules and regulations regarding connections.

Wastewater Discharge Permit
No significant industrial user shall discharge wastewater into the publicly owned treatment works for the Borough of Myerstown without first obtaining a wastewater discharge permit from the Pretreatment Coordinator.

Fireworks Permit
It is unlawful for any person to use or explode any display fireworks in the borough without a permit.

Registrations

On-Street Handicap Parking Space Registration
In order to designate an on-street parking space reserved for persons with a disability or severely disabled veterans at or near a person’s residence, a person must apply to the Borough with an application fee, and be approved by a majority vote of the Borough Council, and upon approval register annually with the Borough and pay an annual registration fee.

Foreclosure Property Registration
Any property for which a public notice of default has been filed, which is in foreclosure, or that has been transferred to lender or mortgagee by any legal method, must register with the Borough and meet inspection, security, and maintenance requirements.
